El trabajo pretende arrojar luz sobre las posibles res­tricciones a las que se podrían ver sometidos en este ámbito los miembros de la ju­dicatura con motivo del especial contenido de las funciones que desarrollan. En este artículo se presenta una propuesta formativa utilizando el cine como material cultural y fuente de conocimiento. Una película como Babel permite trabajar la globalización y la educación de la ciudadanía, con planteamientos que exigen un nuevo humanismo, una nueva relación interpersonal, conscientes de los problemas de comunicación, prejuicios y choques culturales derivados del desarrollo tecnológico. La película cuestiona esta existencia en un mundo global interrelacionado, evocando el viejo mito bíblico de la Torre de Babel haciendo énfasis en identificaciones (...) erróneas, malentendidos y oportunidades fallidas, como manos invisibles que nos guían; o el fin cuyo destino se nos escapa.Babel hace comprender la realidad de la globalización. Nos permite observar cuatro lugares tan distantes como Estados Unidos, Méjico, Marruecos y Japón, no sólo distanciados físicamente. Los cuatro países representan estilos culturales diferentes, tres formas de realización humana. Asistimos al choque, a la incomunicación personal, al aislamiento por la diferencia de cultura y la ficticia proximidad tecnológica. Vivimos juntos, pero aislados los unos de los otros. (shrink)

In this paper, I propose an account of self-knowledge for desires. According to this account, we form beliefs about our own desires on the basis of our grounds for those desires. First, I distinguish several types of desires and their corresponding grounds. Next, I make the case that we usually believe that we have a certain desire on the basis of our grounds for it. Then, I argue that a belief formed thus is epistemically privileged. Finally, I compare this account (...) to two other similar accounts of self-knowledge. (shrink)

Pleasants argues in favour of the idea of basic moral certainties. Analogous to Wittgenstein’s basic empirical certainties, basic moral certainties are universal certainties that cannot be justified, asserted or meaningfully doubted. They are a fundamental condition of morality as such, thus allowing us to carry out other moral operations. Brice and Rummens have criticized Pleasants’ proposal, arguing that basic moral certainties are significantly disanalogous to Wittgenstein’s basic empirical certainties. Brice argues that Pleasants does not differentiate between a bottom-up and a (...) top-down approach to basic certainties nor does he acknowledge the difference that this distinction constitutes in the foundational role of a certainty. Meanwhile, Rummens claims that basic moral certainties are not universal. Conversely, they are moral hinges embedded in certain culturally and historically specific moral language-games. Pleasants has provided a response to these criticisms, while defending the universality and naturalism of basic moral certainties. In this article, I single out the problems in Pleasants’ response to the criticisms introduced by Brice and Rummens. I argue that Pleasants must present further arguments in order to demonstrate that basic moral certainties are analogous to basic empirical certainties. I also argue that the existence of basic moral certainties that coalesce with numerous exceptions and suspensions generates significant problems in Pleasants’ proposal. I advance two cases regarding euthanasia that meaningfully challenge and doubt Pleasants’ central basic moral certainty: the wrongness of killing innocent human beings. Additionally, both cases are employed to meaningfully doubt and challenge Pleasants’ basic moral certainty of the badness of death. (shrink)

In recent years, several studies have advocated the need to expand the concept of patient autonomy beyond the capacity to deliberate and make decisions regarding a specific medical intervention or treatment (decision-making or decisional autonomy). Arguing along the same lines, this paper proposes a multidimensional concept of patient autonomy (decisional, executive, functional, informative and narrative) and argues that determining the specific aspect of autonomy affected is the first step towards protecting or promoting (and respecting) patient autonomy. These different manifestations of (...) autonomy are not mutually dependent; there may be patients who have problems in one dimension, while at the same time being fully autonomous in others. Nevertheless, a close interaction has been observed between the various dimensions and indeed, a phenomenological analysis shows that damage to or a reduction in one aspect of people’s capacity for self-government generally affects other aspects of their autonomy, which in turn disrupts their identity and the way in which they see themselves and are seen by others. In this paper, I shall examine some of these interactions and show how they may lie at the heart of the problem of poor treatment adherence (where adherence is defined as being the extent to which a patient’s behavior over time coincides with the recommendations made by and agreed with their health professional). One example given is that of psoriasis, a chronic skin disease with a very poor adherence record. In Spain, it is calculated that 85% of patients diagnosed with mild to moderate psoriasis fail to comply properly with their treatment, and figures from other parts of the world are similar. Although there are many possible causes for non-adherence among psoriasis patients, assessing their decisional, executive and narrative capacities and taking appropriate action based on the results may help increase adherence rates. This book offers a philosophical account of memory. Memory is remarkably interesting from a philosophical point of view. Our memories interact with mental states of other types in a characteristic way. They also have some associated feelings that other mental states lack. Our memories are special in terms of their representational capacity too, since we can have memories of objective events, and we can have memories of our own past experiences. Finally, our memories are epistemically special, in that beliefs formed (...) on the basis of our memories are protected from certain errors of misidentification and justified in a way which does not rely on any cognitive capacity other than memory. The aim of the book is to explain these features of memory. It proposes that memories have a particular functional role which involves past perceptual experiences and beliefs about the past and suggests that memories have a particular content as well; they represent themselves as having a certain causal origin. The book then accounts for the feelings associated with our memories as the experience of some of the things that our memories represent; things such as our own past experiences, or the fact the memories originate in those experiences. It also accounts for the special justification for belief afforded by our memories in terms of the content that memories have. The resulting picture is a unified account of several philosophically interesting aspects of memory. (shrink)

Research on individual differences in facing the COVID-19 pandemic seems to be crucial in order to design diverse and highly effective intervention strategies. This study uses a sample of 302 North American participants who were recruited through the crowdsourcing platform ProA; different profiles were established, profiling variables of interest in facing the COVID-19 outbreak. Socio-demographic and psychological (personality traits, gratitude, life purpose, and religiosity) variables were explored. Summary This paper aims to bridge anthropological and cognitivist research undertaken by Gilbert Durand and Mark Johnson, who studied the phenomenon of meaning making in a similar way, although they had to use different terminology as their disciplines demanded. Durand established systematization for analyzing symbolism by taking into account the position of the body and the perceptions determining the underlying schemata of symbols. Two decades later, Mark Johnson described image schemata as gestalts having an internal structure derived from bodily perceptions. (...) Owing to these similarities, a comparison between Durand and Johnson’s theories is offered first. In the second place, I reviewed the cognitive value of the anthropological regimes of imaginaire described by Durand. During the analysis, the terminology used by these theorists (like ‘image schemata’ or ‘axiomatic schemata’) was comparatively analyzed to find common ground between their positions. In conclusion, the need for recovering theories of imagination proposed by heterodox scholars like Durand is highlighted, since they anticipate the role of images and imagination not only in language, as Johnson demonstrated, but also in the formation of anthropologically relevant symbols, which are of interest for the analysis of literature and other arts. ABSTRACTIn recent years, with Europe witnessing its worst refugee crisis since the Second World War, the process of applying for asylum in a foreign country has become the focus of numerous studies and research programs. The aim of the present article is to explore the subject through a case study of the issues and complexities surrounding the interpreting and translation services offered by the Spanish Asylum and Refugee Office. The data is based on two surveys: the first focused on the (...) professionals’ views of the role of translators and interpreters, and the second on translators and interpreters working in the field of international protection. The findings obtained from these studies may prove useful for improving the various interpreting and translation training programs and services that are crucial for managing the refugee crisis and the multiple problems associated with it. Projectibility has traditionally been given a prominent role in natural kind theories. However, where most of these theories take projectibility to be a necessary but insufficient feature of natural kinds, this paper defends an account of natural kinds according to which the naturalness of kinds is to be identified with their degree of projectibility only. This view follows thus the path opened by Häggqvist (2005), although it goes significantly further on two main respects. First, I develop and discuss two important (...) dimensions of projectibility that are overlooked in Häggqvist’s work. Second, I address two recent important objections (Magnus 2012 and Spencer 2015) against projectibility-based accounts. (shrink)

This study shows that firms respond in strategic ways to institutional pressures that stem from social scandals. Through the formal analysis of the historical narrative of events, the authors studied how seven pharmaceutical companies reacted over the years to accusations of being socially irresponsible in dealing with the HIV virus in Africa. The analysis shows that institutional and task environmental factors interact to precipitate pharmaceutical companies' reactions. Although firms' behaviors were indeed affected by institutional pressures exerted by activist groups and (...) the media, they did not passively adapt to these pressures. Instead, they decoupled their core technical activities from their policy announcements (by delaying the implementation of promised concessions) and used institutional pressure in the organizational field as a way of pursuing their own economic interests. This essay offers a discussion and contextualisation of a series of letters exchanged between Jordi Cat and Paul Feyerabend from 1989 to 1994. These letters provide insights into Feyerabend’s later thought on a variety of themes including quantum holism, the disunity of science, the development of logical empiricism, and science activism. In doing so, we provide some original analysis and exegesis of Feyerabend’s evolving views on scientific methodology and quantum mechanics by focusing on Feyerabend’s changing attitudes towards Bohm, Bohr, (...) and his eventual colleague Hans Primas and his later sympathies with the algebraic approach. We also highlight Feyerabend’s role in the growth of the Disunity of Science movement and how he connected disunity to practical considerations in the philosophy of action. (shrink)

Recent research on autonoetic consciousness indicates that the ability to remember the past and the ability to project oneself into the future are closely related. The purpose of the present study was to confirm this proposition by examining whether the relationship observed between personality and episodic memory could be extended to episodic future thinking and, more generally, to investigate the influence of personality traits on self-information processing in the past and in the future. Results show that Neuroticism and Harm Avoidance (...) predict more negative past memories and future projections. Other personality dimensions exhibit a more limited influence on mental time travel . Therefore, our study provide an additional evidence to the idea that MTT into the past and into the future rely on a common set of processes by which past experiences are used to envision the future. The aim of this paper is to defend the view that judgments based on episodic memory are immune to error through misidentification. I will put forward a proposal about the contents of episodic memories according to which a memory represents a perception of a past event. I will also offer a proposal about the contents of perceptual experiences according to which a perceptual experience represents some relations that its subject bears to events in the external world. The combination of the (...) two views will yield the outcome that the subject is always an intentional object of her own memories: In episodic memory, one remembers being the subject whose extrinsic properties were experienced in some past perception. For that reason, one cannot misidentify oneself in memory unless one is having an inaccurate memory. Thus, the source of immunity to error through misidentification in memory lies in the nature of mnemonic content. (shrink)

Nursing policy and healthcare reform are focusing on two, interconnected areas: person‐centred care and fundamental care. Each initiative emphasises a positive nurse–patient relationship. For these initiatives to work, nurses require guidance for how they can best develop and maintain relationships with their patients in practice. Although empirical evidence on the nurse–patient relationship is increasing, findings derived from this research are not readily or easily transferable to the complexities and diversities of nursing practice. This study describes a novel methodological approach, called (...) holistic interpretive synthesis (HIS), for interpreting empirical research findings to create practice‐relevant recommendations for nurses. Using HIS, umbrella review findings on the nurse–patient relationship are interpreted through the lens of the Fundamentals of Care Framework. The recommendations for the nurse–patient relationship created through this approach can be used by nurses to establish, maintain and evaluate therapeutic relationships with patients to deliver person‐centred fundamental care. Future research should evaluate the validity and impact of these recommendations and test the feasibility of using HIS for other areas of nursing practice and further refine the approach. (shrink)

The purpose of this chapter is to determine what is to remember something, as opposed to imagining it, perceiving it, or introspecting it. What does it take for a mental state to qualify as remembering, or having a memory of, something? The main issue to be addressed is therefore a metaphysical one. It is the issue of determining which features those mental states which qualify as memories typically enjoy, and those states which do not qualify as such typically lack. In (...) sections 2 and 3, I will discuss the two main existing conceptions of the conditions that a mental state must satisfy to count as an episode of remembering. The first of these approaches is backward-looking. It puts forward conditions that strictly concern the aetiology of the mental state. I will argue that the conditions offered by the backward-looking approach are both too strong and too weak: They rule out mental states which, intuitively, count as memories while including mental states which, intuitively, do not qualify as memories. The second approach is forward-looking. It puts forward conditions that only concern the use that the subject makes of the mental state while forming beliefs about their own life. I will argue that the conditions proposed by the forward-looking approach are both too weak and too strong as well. However, the discussion of the two approaches will allow us to extract some helpful lessons on the constraints that any proposal about the nature of remembering should respect. An alternative approach aimed at incorporating those lessons will be offered in section 4 by drawing on the literature on functionalism. In section 5, I will argue that this approach can, on the one hand, accommodate as memories those mental states which indicate that the backward-looking approach and the forward-looking approach are too strict while, on the other hand, excluding those mental states which suggest that the two alternative approaches are too permissive. Accordingly, I will conclude that construing memory along functionalist lines is a satisfactory approach to the nature of remembering. (shrink)

Although most consumers are positive about socially responsible companies, in order to benefit from CSR efforts, effective and clear CSR communication is important. However, due to the constantly rising profusion of eco-labels, based on either own claims from the organization or claims made by an external third party, consumers may encounter difficulties in identifying truly responsible firms, which could result in less effective CSR initiatives, even for those responsible firms. Therefore, building on attribution theory, this study seeks to identify how (...) uncertified internal CSR claims and external third-party CSR labels should be used in order to deter greenwashing and increase positive consumer evaluations. Within a 3 × 2 design, respondents are exposed to different coffee product packages measuring their attitude toward the brand, corporate credibility, purchase intention, and scent perception, as well as perceived attributional CSR motives. Overall, findings indicate that especially an external CSR label affects consumer responses toward the firm. Moreover, perceived CSR motives serve as a mediator between an external CSR label and corporate credibility and brand attitude, respectively. These findings warrant further consideration of introducing an external multilevel rating systems by governmental law. (shrink)

El presente artículo investiga de qué forma la centralidad del sufrimiento en la filosofía de Schopenhauer sirve para fundamentar su pesimismo. Tres son los argumentos analizados: el lugar del sufrimiento en el mundo, su lugar en la conciencia humana y su lugar frente a la felicidad. A la luz de estos tres argumentos, se destaca que el vínculo indisoluble entre el sufrimiento y la esencia del mundo, la determinación del sufrimiento en la conciencia, tanto en su génesis como en su (...) intensidad, y su anterioridad ontológica frente a la felicidad hacen del pesimismo una categoría necesaria. Finalmente, se señala una posible contribución del pesimismo schopenhaueriano a la crítica social contemporánea, considerando la idea de mundo que el capitalismo tardío promueve. (shrink)

En esta investigación se muestra cómo la persistencia de una concepción jurídica diática de la propiedad ha invisibilizado el carácter hist´rocio, social y político de la misma, naturalizando la desigualdad resultante. Se realiza un examen de cómo el realismo jurídico y la concepción de la propiedad como "haces de derechos" contribuyó a resignificarla como realidad históricamente contingente, sujeta a condiciones e intereses económicos, sociales y políticos. Finalmente, en el artículo se discute cómo la cristalización de los "haces de derechos" en (...) la conceptualización y regimentación de los bienes comunes puede constituir una promisoria herramienta -analítica y normativa- para la democratización de la propiedad en el mundo contemporáneo. There is a little explored tension between the regulations called for by environmentalists and the predominant liberal political theory. The latter says that laws are only legitimate when publicly defensible to all who must follow them and thus does not support the state adoption of particular values. Environmental concerns frequently fall under the category of particular values. I explore ways that liberalism does in fact support environmental regulations as furthering universal rights and justice within and between generations. However, some forms (...) of environmental preservation are clearly government pursuits of particular values. I explore possible liberal justifications of publicly fostering environmental values and conclude by arguing for a deliberative democratic approach. (shrink)

Memories are mental states with a number of interesting features. One of those features seems to be their having an intentional object. After all, we commonly say that memories are about things, and that a subject represents the world in a certain way by virtue of remembering something. It is unclear, however, what sorts of entities constitute the intentional objects of memory. In particular, it is not clear whether those are mind-independent entities in the world or whether they are mental (...) entities of some kind. The purpose of this chapter is to map the different positions on this issue, and to highlight the virtues and difficulties for each of the options. In Section 2, I will specify the question of what the intentional objects of memory are by clarifying the relevant notions of memory and intentional object. In Section 3, I will motivate the significance of identifying the intentional objects of memory by exploring the relations between, on the one hand, the intentionality of memory and, on the other hand, the phenomenology and the epistemology of memory. In Section 4, I will consider two natural candidates for being the intentional objects of memory, namely, worldly entities and mental entities, and I will raise some concerns for each of the two candidates. A promising alternative will emerge, in Section 5, as preserving the virtues of the two original candidates while avoiding their difficulties. The alternative will concern a certain combination of worldly and mental entities; a combination that involves both causal and truth-making relations. I will conclude by sketching how the alternative candidate can shed some light on the phenomenological and epistemological issues raised in the third section. (shrink)

Are those judgments that we make on the basis of our memories immune to error through misidentification? In this paper, I discuss a phenomenon which seems to suggest that they are not; the phenomenon of observer memory. I argue that observer memories fail to show that memory judgments are not IEM. However, the discussion of observer memories will reveal an interesting fact about the perspectivity of memory; a fact that puts us on the right path towards explaining why memory judgments (...) are indeed IEM. The main tenet in the account of IEM to be proposed is that this aspect of memory is grounded, on the one hand, on the intentionality of perception and, on the other hand, on the relation between the intentionality of perception and that of memory. The purpose of this essay is to account for privileged access or, more precisely, the special kind of epistemic right that we have to some beliefs about our own mental states. My account will have the following two main virtues. First of all, it will only appeal to those conceptual elements that, arguably, we already use in order to account for perceptual knowledge. Secondly, it will constitute a naturalizing account of privileged access in that it does not posit any mysterious (...) faculty of introspection or "inner perception" mechanism. (shrink)

In this paper I argue against Simion’s (2018) Epistemic Limiting Procedure for conceptual engineering and put forward a more permissive alternative, according to which epistemic losses do not systematically block amelioration, but merely provide reasons against it. On this less restrictive view, epistemic losses will be permissible, provided that they are compensated by the non-epistemic gains of the amelioration. After fleshing out the details of my proposal, I discuss two case studies in relation to which Simion’s restrictive procedure seems to (...) yield the wrong predictions. I argue that my alternative accommodates these cases significantly better. (shrink)

The purpose of this essay is to determine how we should construe the content of memories or, in other words, to determine what the intentional objects of memory are.1 The issue that will concern us is, then, analogous to the traditional philosophical question of whether perception directly puts us in cognitive contact with entities in the world or with entities in our own minds. As we shall see, there are some interesting aspects of the phenomenology and the epistemology of memory, (...) and I shall aim at a specification of the content of memories that is in accordance with those aspects of them.
